Public Hearing: Planning Commission Meeting for Proposed Restaurant Ordinance Changes

The Town of Vienna Planning Commission will be holding a public hearing on September 13th for proposed changes to the Zoning Ordinance in regards to restaurants.

Currently, per the Code, restaurants are only allowed in freestanding buildings which are able to accommodate at least 125 seats (along with the parking required by those 125 seats), shopping centers, office buildings, and as incidental parts of department stores, drug stores, motels, and similar businesses.Town Staff will be recommending that the Planning Commission recommend to the Mayor and Town Council amendments to Section 18-72 of the Town Code (the Code section with the restaurant language). The proposed Code amendments would remove the existing minimum seat and location criteria for restaurants and allow restaurants as a by-right use anywhere in the C-1 zoning district (and therefore the C-1A, C-1B, C-2, and CM zoning districts – due to cumulative zoning). As the result of two work sessions with the Planning Commission, Staff also recommends amending Section 18-4 of the Town Code, to amend the definition of restaurant, carry-out service and remove the definition of carry-out food business. The changes to the definitions will help to clarify that carry-out restaurants are permitted in the commercial zones. Additionally, Staff recommends that uses other than office and administrative uses, as permitted by the zoning district (which includes restaurants), be allowed on the ground floor of office buildings. Currently, office buildings “shall be occupied solely for professional use or the administrative activities accessory to other than professional uses.”
